Natural resources often stretch across borders that separate modern nation states. This can create conflict and limit opportunities for regulated consumption of their goods and services, but also provide opportunities for joint multinational efforts that exceed single country capabilities. This book illustrates the diversity of transborder natural resources, the pressures that they experience or the opportunities that exist for multinational regulatory regimes, monitoring and enforcement. It presents ten case studies of transborder natural resources that are of interest to two or more neighboring countries, and that are subject to, or in need of bilateral or multinational coordinated management. The case studies include the exploitation of specific marine resources in international waters, rivers that travel through several countries and contiguous tropical forests across national borders, and where commodities, nature conservation or even territorial integrity are at stake. They are drawn from across the globe, including flood management in Western Europe, tropical forests in the Western Amazon, hydropower development in the Mekong region of South-east Asia, forest conservation in Central Africa and marine resource and fisheries exploitation in the waters of Japan, South-east Asia and Australia. Together the chapters provide a review of a wide range of transborder natural resource examples, and the diverse regulatory regimes that need to be devised to achieve successful management. An introductory chapter provides a conceptual and theoretical underpinning that can guide future research efforts on similar cases and a concluding chapter draws major conclusions and implications for related concepts and theories.

This book analyses the Habitats Directive; one of the most prominent piece of EU environmental legislation of the past decades. Seen by some as the cornerstone of Europe’s nature conservation policy, among other measures the Directive established the so-called "Natura 2000" ecological network, which covers more than 18% of the surface of the EU. However, despite the fact the Directive was adopted over twenty years ago only 17% of the protected habitats and species in Europe are being adequately protected while 10-60 % of animal species remain under threat. In light of the limited success and the contested nature of the Habitats Directive so far this book examines the successes and failures of the Habitats Directive from a legal and political angle. The book brings together international experts to consider the application, implementation and future of the Habitats Directive in order to assess whether the Habitats Directive is resilient enough to tackle biodiversity loss in the twenty- first century. Particular emphasis is put on the legal regime attached to the Natura 2000 network and its possible impact on land development and the relationship between the Habitats Directive and other topics including liability for ecological damage and transboundary nature conservation.

Serving as a single volume introduction to the field as a whole, this book seeks to present international law as a system that is based on, and helps structure, relations among states and other entities at the international level. It identifies the constituent elements of that system in a clear and accessible fashion.

In Asia, where authoritarian-developmental states have proliferated, statehood and social control are heavily contested in borderland spaces. As a result, in the post-Cold War world, borders have not only redefined Asian incomes and mobilities, they have also rekindled neighbouring relations and raised questions about citizenship and security. The contributors to the Routledge Handbook of Asian Borderlands highlight some of these processes taking place at the fringe of the state. Offering an array of comparative perspectives of Asian borders and borderlands in the global context, this handbook is divided into thematic sections, including: Livelihoods, commodities and mobilities Physical land use and agrarian transformations Borders and boundaries of the state and the notion of statelessness Re-conceptualizing trade and the economy in the borderlands The existence and influence of humanitarians, religions, and NGOs The militarization of borderlands Causing us to rethink and fundamentally question some of the categories of state, nation, and the economy, this is an important resource for students and scholars of Asian Studies, Border Studies, Social and Cultural Studies, and Anthropology. In this contribution to the academic and policy debates surrounding the management and governance of shared natural resources, the focus is placed on River Basin Organizations as the key institutions for managing internationally shared water resources. The book includes advide to policy makers based on worldwide analysis, and three detailed case studies from three continents: the Senegal (West Africa), Mekong (South-east Asia) and Danube (Europe) rivers.

This study explores how environmental governance mechanisms affect state management of forest roads to address the chronic delivery of sediment to streams in Oregon, Washington, and California on private and state forestlands. Forest roads can degrade water quality and harm aquatic life when runoff mobilizes fine sediments from the road surface into streams. This study uses content analysis and semi-structured interviews with experts in each state to describe and evaluate the environmental governance mechanisms that shape state approaches to forest road management. General trends, such as the strong role of the Endangered Species Act and weaker role of the Clean Water Act, were found across all three states in varying degrees. In Washington, the role of tribal reserved rights emerged as a unique driver of policy compared to Oregon and California. This research reveals that federal laws around non-point source pollution and endangered species conservation play out differently in different contexts and can be used to inform decision-making as the EPA assesses potential changes to management of forest roads at the federal level under the Clean Water Act.

This extensive reference writes a modern history of forestry in Japan, Indonesia, the Solomon Islands, and other Asian countries, reflecting industrial and colonial exploitation, periods of excessive deforestation, and the alienation of local residents from natural resources. Drawing on their experience as"participant observers"in local practice, the authors suggest new,"inclusive"approaches to forestry governance that support sustainable development, environmental preservation, and the productive collaboration by various stakeholders. The mismatched interests of local citizens and outsiders have split the development of Asia's natural and cultural resources. Taking this complexity into account, the essays in this volume advance a definition of effective governance that achieves more than the successful execution of resource management. It pursues a new vision of society in which all stakeholders collaborate to govern the use of certain resources. This volume outlines two key conditions for effective resource management: sharing and commitment (or graduated membership), which transcend mere material issues to determine the social and cultural value of a resource.
