Early 2012 the OECD released a Review on Telecommunications Policy and Regulation in Mexico, which was heavily criticized by a few consultants of Mexico's incumbent telephone companies. The OECD answered the objections only formally, arguing that the study was performed according to established procedures and that it had been approved by all its member states. Last year the Trimestre Económico, one of Latin America's leading economic journals, dedicated a special issue to the unresolved controversy. Apart from publishing translations of two of the three articles criticizing the Review, a few selected authors shed their light on the subject matter. The purpose of this paper is to show that the articles of the Trimestre complicate matters unnecessarily and that the quantitative results of the Review are simply erroneous and inconsistent. To see that there is no need for sophisticated econometric exercises; just a revision of the figures, some rigor of analysis and a skeptical look at a partial-equilibrium graph are sufficient to make clear that the findings of the OECD are out of touch with reality.

According to the OECD Review on Telecommunication and Broadcasting in Mexico 2017, the performance of the industry since the reforms of 2013 and 2014 has been remarkable and demonstrates what can be achieved with evidence-based policy making. In my view, the Review rather demonstrates what can be achieved by manipulating the evidence at will. It attributes to the reforms achievements that were well underway long before and closes its eyes to the many difficulties faced during their implementation. It is simply too early to arrive at an evaluation of reforms whose effects cannot be expected overnight. The Review is a good example of selling the skin before shooting the bear. By applauding the reforms the way the Review does, the OECD lost the opportunity to take albeit a bit of distance.

According to the Review of Telecommunication Policy and Regulation in Mexico published by the OECD in January 2012, the performance of the Mexican telecommunications industry in terms of prices and penetration has been poor in comparison with other OECD countries. This would have led to a welfare loss to the Mexican economy of 129.2 billion dollars over the 2005-2009 period; ie. 1.8% of national GDP. The poor performance is attributed to a lack of competition in Mexican telecommunication markets. These findings are supported by an econometric study establishing a causal link between the degree of competition and the performance indicators. In this article I criticize the findings of the OECD arguing that in comparison with OECD averages Mexican prices have not been high, that penetration ratios are reasonably acceptable given Mexico's stage of economic development, that they are steadily catching up with OECD standards and, finally, that the econometric study fails to establish a causal link between the degree of competition and performance. Particularly, I show that there is no theoretical justification for comparing prices in purchasing power parity dollars, as the OECD does. Moreover, I indicate a number of elementary errors in the econometric study inflating the welfare loss beyond any proportions.

The OECD's proposed regime of asymmetric ex ante regulation for Mexico's telecommunications marketplace would reduce competition, contrary to the OECD's aims. The OECD's proposals would harm Mexican consumers and force an increase in prices paid for telecommunications services. They would create a government-sanctioned price cartel among the telecommunications providers. They would reward inefficient competitors and penalize efficient carriers, all to the detriment of the consumers. Instead of relying on new layers of counterproductive or ineffective regulations, the Mexican government should remove regulatory entry barriers between video and telephone, thereby creating enduring, facilities-based competition.
