On an application for an order directing II., who was alleged to lie the plain- tiff's attorney, to declare in writing the profession, occupation or quality and place of abode of the plaintiff, the only evidence adduced was an affidavit of the partner of defendant's attorney, stating that two notices annexed were served on H., and he had not complied with them. The notices were: ?(i) A demand to declare in writing the profession, occupation or quality and place of alicde of plaintiff. (2) A demand of security for costs. Each was addressed to N. F. H, Esq., plaintiff's nttorney, and on each was endorsed, Service hereof admitted on date. N. F. H, plaintiff's attorney. No demand was made upon H ? as to whether the writ was issued by him, or with his authority or privity. Held, That there was not sufficient evidence that II was plaintiff': . attorney, and had so refused. Argued, 230! October, 1890. Decided, 23rd October. 1890. Statement. This was an appeal from an order of the referee directing N. F. H to declaring in writing to the defendant's attorney within one day, the profession, occupation or quality and place of abode of plaintiff. The facts sufficiently appear from the judgment and head note. Mr. Botinar, for plaintiff Mr. A.J. Andrews, for defendant, relied on rule 101.
