Key Findings Sweeping reductions and changes to the enforcement program in BC have had a serious and negative impact on the ability of workers to become aware of their rights in the workplace, to complain of violations of their rights, and to obtain fair treatment in the process of pursuing complaints and having their complaints adequately investigated. The Employment Standards Act of British Columbia sets minimum standards for terms of employment and working conditions in most workplaces that fall under provincial legislative jurisdiction. This consultation paper is issued in connection with the British Columbia Law Institute's Employment Standards Act Reform Project, which is the first comprehensive, independent review of the Act to be carried out in more than 25 years. The consultation paper reviews the Act and advances tentative recommendations for its reform. The tentative recommendations are intended in part to address transformative change in the workplace brought about by digitalization, the growth of precarious work, and demands from employers and workers alike for greater “flexibility” in working arrangements. They also address issues relating to the enforcement of the Act. The consultation paper has been issued to seek public comment on the tentative recommendations, which is requested by 31 August 2018. A subsequent report will contain final recommendations on reform of the Act.
