Excerpt from Report of the Select Committee on Location Act, 1906 (3). Some means should be devised for rendering the application of section 10 of the present law (Act 30 of 1899) to some extent, subject to the control and decision of the Divisional Council. This section deals with the exemption of natives, who are lessees of property, from the provisions of the law, and the Divisional Council should be given power to decide what number of such natives shall be allowed to take advantage of this provision of the Act, or in some other way to take steps to see that undue advantage is not taken thereof. (4). It would be of great benefit to the proper carrying out of the provisions of the Location laws if the Divisional Council were required to send in to the Civil Commissioner, from time to time, lists of the number of private locations in the division, with the number and names of the native male adults residing in them. Provision could then be made for giving these lists authority in Courts of Law so that such natives as may be found in a private location and whose names do not appear on the list relating to such location shall be deemed to have been there contrary to law. (5). In conclusion, it would be as well that, in any law dealing with the above subjects, there should be provision that any Divisional Councillor who shall be interested in any question relating to private locations which may come before the Council, shall not have a vote thereon.
