La actual reforma del Derecho marítimo español operada a través de la Ley 14/2014, de 24 de julio, de Navegación Marítima hace necesario repensar y sistematizar el nuevo régimen jurídico aplicable a los principales contratos de la navegación. Esta obra ofrece un completo análisis de las formas contractuales a través de las cuales se articula el transporte marítimo de pasajeros, siendo el pasaje y el crucero los contratos que la normativa toma como arquetipos. Además de ello, el transporte marítimo de pasajeros juega un papel central en la consecución del principio de continuidad territorial, cubriendo una importante función de interés público; al mismo tiempo, la prestación de tal servicio ha de considerarse a la luz de la normativa de defensa de la competencia. La Ley de Navegación Marítima ha permitido superar la anticuada regulación del Código de Comercio de 1885, toda vez que la interpretación de la nueva Ley ha de ser armonizada con los Reglamentos comunitarios sobre la responsabilidad de los transportistas de pasajeros por mar en caso de accidente –R. (CE) 392/2009- y sobre los derechos de los pasajeros que viajen por mar y por vías navegables –R. (UE) 1177/2010-, así como con la normativa nacional e internacional en materia de seguridad. Dichas normas han supuesto la modernización de la disciplina por lo que respecta a la responsabilidad y a los derechos de los pasajeros. Sin embargo, es necesario trazar los adecuados puentes de conexión que permitan encajar sus reglas con el nuevo Derecho marítimo construido en la Ley de Navegación, cuyo articulado es igualmente analizado en esta obra. Tras un encuadramiento del sector y de la normativa, en este libro se analizan los caracteres y elementos de los contratos de pasaje y crucero, el contenido de las prestaciones que implican su ejecución, las distintas formas de incumplimiento contractual y sus consecuencias jurídicas, y la responsabilidad del transportista en caso de accidentes durante la navegación.
