En aras de promover el conocimiento de toda persona que se interese por la normativa legal que actualmente rige nuestra vida cotidiana en materia de tránsito, es que se ha decidido publicar este compendio de normas sobre la materia, que incluye la propia Ley de Tránsito, como también la Ley que Establece Procedimiento Ante los Juzgados de Policía Local, las denominadas Ley de Tolerancia Cero y la Ley Emilia, Reglamento Sobre Transporte Público de Pasajeros, entre otras. Además, con el objeto de ilustrar a los lectores sobre algunas de las normas más comentadas de los últimos años, se incluyeron dos apartados al final de esta publicación que muestran, en términos prácticos, cuáles son los efectos de las modificaciones efectuadas a la Ley de Tránsito por las ya mencionadas Ley Tolerancia Cero y por la Ley Emilia. Por último, también se ponen en conocimiento del lector las consideraciones más sustantivas de dos fallos del Tribunal Constitucional sobre esta última norma, que se refieren a la problemática principal que existe entre la aplicación del artículo 196 ter de la Ley N° 18.290, incorporado por la Ley N° 20.770, y su colisión con las garantías constitucionales contenidas en los artículos 19, N° 2° y 3°; y 5°, inciso segundo, de la Constitución Política de la República, ya que el primer artículo mencionado impone la pena efectiva de cárcel durante, al menos, un año en ciertos delitos, lo que genera contradicciones con la igualdad ante la ley y el principio de proporcionalidad contenidos en la Carta Fundamental. Esperamos que esta publicación sea de utilidad y facilite el conocimiento y entendimiento de esta normativa por parte de los lectores.

For the first time in the republican history of Peru, the presidential transition takes place in democracy, social peace, fast economic growth and favorable world markets. In other words, there has never been a better chance to build a different Peru - a richer country, more equal and governable. There are multiple ways to achieve that goal. New reforms must stem from a widespread and participatory debate, one of a common vision conceived for and by Peruvians. This book aims at making a technical and independent contribution to such debate; it summarizes the knowledge available about the challenges to be faced by the new administration. The study does not recommend silver bullets, but suggests policy options. It is based on the analysis of the current reality and in six decades of relationships with Peru, in which the Bank has implemented more than 100 projects and prepared more than 500 technical reports covering the wide range of development topics. When necessary, the study provides lessons that the Bank has learned elsewhere. The study provides a conceptual framework to the analysis of the country's 34 economic sectors and the two historical perspectives behind them. In doing so, it offers a comprehensive reform agenda that sheds light on possible priorities and courses of action.
