It's become more challenging to protect Intellectual Property Rights generated in space activities as it is governed by various international laws, customary laws and treaties etc. It is very much important to formulate a mechanism for the protection of the Intellectual Property rights in outer space activities. Today, the World is facing great challenge for protection of unenhanced or unprocessed satellite image because copyright protection is not available to this either in the Berne Convention or Universal Copyright Convention because unprocessed Data are directly received from satellite and there is no human creativity involved in unprocessed data. Satellite images or remote sensing data are required for development of all nations, whether they are developing or developed. Since India is one of such nations who is entering into commercialization of space services such as remote sensing, satellite lunching, etc. India needs to have adequate legal coverage in these areas. India needs copyright protection to protect not only satellite image but also raw or unprocessed data. There is immediate need for a suitable legislation in this area.

U.S. space-based remote sensing programs and activities are facing a number of critical junctures in the coming decade. David Stevens Space-based information, which includes earth observation data, is increasingly becoming an integral part of our lives. We have been relying for decades on data obtained from meteorological satellites for updates on the weather and to monitor weather-related natural disasters such as hurricanes. We now count on our personal satellite-based navigation systems to guide us to the nearest Starbucks Coffee and use web-based applications such as Google Earth and Microsoft Virtual Earth to study the area of places we will or would like to visit. At the same time, satellite-based technologies have experienced impressive growth in recent years with an increase in the number of available sensors, an increase in spatial, temporal and spectral resolutions, an increase in the availability of radar satellites such as Terrasar-X and ALOS, and the launching of specific constellations such as the Disaster Monitoring Constellation (DMC), COSMO- SkyMed (COnstellation of small Satellites for the Mediterranean basin Observation) and RapidEye. Even more recent are the initiatives being set-up to ensure that space-based information is being accessed and used by decision makers, such as Sentinel Asia for the Asia and Pacific region and SERVIR for the Latin America and Caribbean region.

India having taken international obligations under the space treaties, thus ought to confirm with the principles established thereof while carrying out its space operations. At present Indian space programs essentially remain a governmental activity and this approach has been witnessed to work well until now. However, with growing interest in space, involvement of private entities remains inevitable and thus, domestic regulatory mechanisms for space activities are due since long. This chapter addresses major avenues involving space viz. launch activities, satellite telecommunications and broadcasting, remote sensing, intellectual property rights and satellite navigational services, in which India has performed extensive activity, but often lacks domestic regulations to balance the rights and obligations.
