Excerpt from State of Illinois Appellate Court, Fourth District: March Term, A. D., 1921; Joseph F. Derousse, Appellee, Vs. Charles R. Bartels, Appellant; Appeal From Randolph It is contended by Appellant that there is absolutely no evidence of negligence on the part of its driver. The evidence shows that the lower end of the guy wire was fastened to a post or iron bar about five feet from the ground and extended in an upward slanting direction to where it was attached to the stack. The evidence tends to show that the top of the van was thirteen feet from the ground. Thei driver admitted that as he passed under the wire it was on the post and that when he saw it next it was off the post. At least one witness on behalf of Appellee testified that the van struck the wire and tore it loose, and that the stack then toppled and fell. The stack had stood in proper position for years and no claim is made that it fell because of a high wind. It would be difficult for a jury or the Court to reach any other conclusion than that there was not sufficient room for the van to pass under the -wire without striking it, and that if the driver was exercising due care he would have observed that such was the situation before he attempted to drive under it.
