Excerpt from Ninth Annual Report for the Calendar Year 1929 The Interborough Company having filed voluminous answers in the two state suits, the, Commission through its counsel moved for a severance of the issues of law and fact, so as to bring squarely before the state courts the question of the binding effect of the fare provisions of Contract No. 3 and the Extensions Certificate. The contentions of counsel to the Commission were upheld by Mr. Justice Frankenthaler at Special Term, New York Law Journal, August 1929, and the case tried before Mr. Justice Ingraham on October 16 and 18, 1929. Recently briefs were submitted and we are awaiting the decision of the court. The Interborough also made a separate application for an increased fare on the elevated lines, which was denied.
