Mahatma Gandhi National Rural Employment Guarantee Act (MGNREGA) was envisaged as a gender sensitive legislation to provide a fair opportunity to women from rural India to earn without any discrimination of gender. In terms of national averages the scheme under the act has achieved its target but there exist a wide variation among the state in the numbers for participation of women workers. This study is an attempt to identify the barriers that have restricted the participation of women. The paper identifies that lack of child care, nature of work, social norms, illegal presence of contractors, delay in payment and lack of involvement of women in the planning stage are the constraints that have limited the participation of women in the Scheme. The involvement of local initiatives likes Kudumbashree and Self Help Groups (SHGs), use of Information Communication Technology (ICT), involvement of NGOs have enabled some states to have a higher participation of women workers than others. The paper concludes with suggestions on policy and implementation measures that could be taken to enhance participation of women in the Scheme and thus, enable the benefits of the Scheme to reach many more rural women.

This paper examines the dynamics of women's claim-making within the Mahatma Gandhi National Rural Employment Guarantee Act (MGNREGA) scheme in India, focusing on their participation in selecting durable assets for climate resilience. Despite legal entitlements and protections for women within the program, gender disparities persist in claiming public resources. Utilizing a mixed-methods approach including surveys and qualitative interviews, the study uncovers various pathways to women’s claim-making, influenced by factors such as gender norms around mobility and women’s voice and agency, internal barriers and constraints including comfort in public speaking, and knowledge of the program and its various procedures for selecting assets. While challenges to women’s effective participation remain, findings from our analysis suggest potential for interventions to reduce gender gaps and enhance inclusivity in planning processes. Moreover, the study underscores the importance of recognizing diverse claim-making pathways to promote inclusion effectively within the program.

In 2005, India passed the National Rural Employment Guarantee Act (NREGA, “the Act”), a law guaranteeing all rural households 100 days of work at a minimum wage through the building of durable assets, which created one of the largest anti-poverty programs in the world. Now known as the Mahatma Gandhi NREGA (MGNREGA), a notable feature of the program is that it envisions a democratic, bottom-up process of choosing which durable assets would be built within a community. Toward this end, the Act gives citizens the right to participate in the process of identifying potential projects and delegates responsibility to village governments in selecting which assets to build. Yet, in the long history of public works programs, there has been limited research on how assets created under such workfare programs are selected, or how to increase the role of women or other marginalized groups in the decision-making process. The Act provides a list of permissible works that span natural resource management, individual and community assets, common infrastructure for women’s groups, and rural infrastructure more broadly. Given the scale of the program, the assets selected at the village level have tremendous potential to enhance rural resilience to unexpected shocks and crises, especially those related to climate change. This is important, as extreme weather events on the Indian subcontinent are increasing, both in frequency and in the magnitude of their impacts on agricultural productivity, household livelihoods, assets and incomes, and health and nutrition. These events, as well as their impacts on incomes, often affect women more severely (Mason and Agan 2015; Kosec et al. forthcoming). Understanding how to enhance women’s voice and agency within the process of selecting community assets is important for three major reasons. First, women and men may have different asset preferences (Chattopadhyay and Duflo 2004). Recent time-use survey data from India find that women spend far more time on unpaid domestic and care work than men (eight times as much) (India, NSO 2019). Thus, women may place relatively more value on projects that reduce effort in collecting fuel and water, for example. If their voices are not included in the asset selection process, the village could miss out on a range of development projects that would improve overall productivity, resilience, and well-being. Second, where projects are built affects who benefits from them. Households that had MGNREGA assets built on their own land or that live near an asset cultivate more land, use more inputs (including their own labor), and have higher agricultural output (Gehrke 2015; Muralidharan et al. 2021). Ensuring that women influence asset placement is thus critical. Third, greater participation and inclusivity in the process of selecting community development projects can increase the perceived legitimacy and satisfaction with projects, as well as willingness to contribute toward their construction and maintenance (Olken 2010). Within MGNREGA, households that report playing a greater role in project selection also report greater satisfaction with the usefulness, quality, and maintenance of the projects (Ranaware et al. 2015).

This paper examines the nexus between legislation, paid employment, women's empowerment and transformative gender equality in India. Using a sample of married women from the India Human Development Survey (IHDS), we find that the government legislated rural employment guarantee, the Mahatma Gandhi National Rural Employment Guarantee Act (MGNREGA), has been instrumental in ensuring paid employment for women - for many married women it is the first opportunity for paid work. We also find paid employment and MGNREGA had positive and significant effects on women's control over household decisions. However, we do not find enough evidence to suggest a transformative impact in terms of breaking the cycle of disadvantage, proxied by the timethe older girl child spends in school.

The National Rural Employment Guarantee Act (NREGA) is one of the most progressive legislations enacted in India, since independence. It's a bold and unique experiment in the provision of rural employment in India and indeed in the world at large. Further, it is the first expression of the right to work as an enforceable legal entitlement. In a country where labour is the only economic asset for millions of people, gainful employment is a prerequisite for the fulfillment of other basic rights - the right to life, the right to food and the right to education. There is much that the NREGA promises from the perspective of women's empowerment as well. Most boldly, in a rural milieu marked by stark inequalities between men and women. In the opportunity for gainful employment afforded as well as wage rates - NREGA represents action on both these counts. The act stipulates that wage will be equal for men and women. It is also committed to ensuring that at least 33% the workers shall be women. By generating employment for women at fair wages in the village, NREGA can play a substantial role in economically empowering women and laying the basis for greater independence and self-esteem.
