Of course, realizing that they were doing it under what might be termed their executive duties--the law making no provision specially for it, or providing any money therefor. But since the law provides that overseers of the poor shall, in their districts, furnish indigent persons with antitoxin free of cost, which the county courts appointing them shall pay for out of the county treasury, it seems to me that the State Board of Health, as a part of its rules and regulations, have an understanding with the county courts and the councils of the cities and towns that it was acting as distributing agent for some laboratory and could furnish them antitoxin for the poor at a low price, which the State Board of Health could do through the local boards. Pursuant to such understanding, it seems to me the State Board coul.d become a distributing agent as you suggest, and not acting in excess of its powers. Of course, pursuant to such understanding, the county courts and the towns would have to pay for the antitoxin used. To do as I have herein suggested would entail much work on your board.
