Whether a background check is required for a firearm transfer in Minnesota is determined by whether a federal firearms dealer is involved. The scope of the check (if one is required) is based on the type of firearm being transferred. In a nutshell, a person who purchases a firearm (any type) from a federal dealer must undergo a National Instant Criminal Background Check System (NICS) check. If the firearm being purchased from the dealer is a pistol or a semiautomatic military-style assault weapon, Minnesota law requires that the transferee produce a valid permit to purchase (i.e., a transferee permit) or permit to carry (both of which require background checks at the time of issuance) or that the dealer files a transfer report with local law enforcement (which prompts a background check). No federal or Minnesota mandated background check is required for transfers of firearms (any type) between private parties (no dealer involvement) living in Minnesota.

More than 180 million applications for firearm transfers or permits were subject to background checks since the effective date of the Brady Handgun Violence Prevention Act on February 28, 1994, through December 31, 2014. During this period, about 2.8 million applications (1.6%) were denied. In 2014, nearly 15 million applications were subject to background checks, and 193,000 (1.3%) were denied, including about 91,000 denied by the FBI and about 102,000 denied by state and local agencies. Data in this report were obtained from the Bureau of Justice Statistics' (BJS) Firearm Inquiry Statistics (FIST) program. The FIST program collects information on firearm applications and denials and combines this information with the FBI's National Instant Criminal Background Check System (NICS) transaction data to produce an estimated number of background checks for firearm transfers or permits since the effective date of the Brady Act. These statistical tables describe trends in background check activities that occurred in 2014 and include partial data for 2013. Data include the number of firearm transaction applications processed by the FBI and by state and local agencies, the number of applications denied, reasons for denial, and estimates of applications by jurisdiction and by each type of approval system.

The Federal Bureau of Investigation (FBI) administers a computer system of systems that is used to query federal, state, local, tribal, and territorial criminal history record information (CHRI) and other records to determine an individual's firearms transfer/receipt and possession eligibility. This FBI-administered system is the National Instant Criminal Background Check System (NICS). NICS, or parallel state systems, must be checked and the pending transfer approved by the FBI or state point of contact before a federally licensed gun dealer may transfer a firearm to any customer who is not also a federally licensed gun dealer. Current federal law does not require background checks for intrastate (same state), private-party firearms transactions between nondealers, though such checks are required under several state laws. In the 116th Congress, the House of Representatives passed three bills that would expand federal firearms background check requirements and firearms transfer/receipt and possession ineligibility criteria related to domestic violence.

The Brady Handgun Violence Prevention Act (Brady Act) requires a background check on an applicant for a firearm purchase from a dealer who is a Federal Firearms Licensee (FFL). During the permanent Brady period, from 1990 through 2008, background checks were conducted on over 84 million applicants for firearms transfers or permits. During this period, nearly 1.5 million applications for firearm transfer or permits were denied by the Federal Bureau of Investigation (FBI) or by state and local agencies, a denial rate of 1.7%. This report summarizes the number of applications for firearm transfers and permits, denials that resulted from background checks, reasons for denials, rates of denials, appeals of denials, and arrests of denied persons during the permanent Brady period.
