Excerpt from A Treatise on the Law of Injunctions A common instance of this equity is the case of a joint bond, where the court infers, from the nature of the condition and the whole transaction, that the bond was made joint by mistake, and that the real intention of the parties was, that it should be joint and several (a). It appears also that similar relief would be given in a case which is the con verse of this: as where a person executes a bond, meaning that it should be the joint bond of himself and another, and not his several bond; in such a case, unless there is something special, the person who had become so severally bound, has a right to have that bond delivered up; for his intention was not to become a mere several obligee, but to be a joint and several obligee, and the rights are different both in law and equity: for if he is only a several obligee he has no remedies over against any one, but if he is a. Joint and several obligee or only a joint obligee, there is a right of contribution against the other sureties in equity, and of exoneration against the principal. Excerpt from Treatise on the Law of Injunctions: As Administered in the Courts of the United States and England The jurisdiction of courts of equity by the writ of injune tion, though of English origin, is largely the result of Amer ican growth and development. Perhaps no branch of equity jurisprudence owes more to the decisions of American courts, and the growing frequency of the use of this writ, of late yars, has invested the subject with a new importance. Of the more recent text-books upon the Law of Injunctions, that of Mr. Hilliard, professing to be purely American, contains, of course, but few citations of English cases, while the English treatises of Mr. Kerr and Mr. Joyce, though complete and exhaustive so far as regards the English authorities, contain but few references to the Opinions of our courts, and leave the rich field of American decisions almost untouched. And the fact that very many of the English authorities, noticeably those of recent date, are modified by statutes which are inap plicable here, has seemed to the author to create an additional necwsity for a work which should be based upon the decia ions of both countries, and which should present the general principles governing courts of equity, both in England and America, in the administration of preventive relief.
