Excerpt from A Treatise on the Law of Injunctions, Vol. 2 908. Inadequacy of the remedy at law and the avoid ing of a multiplicity Of suits are strong grounds for the granting Of injunctions to protect statutory privileges of an exclusive nature. And a franchise to carry out a lottery scheme for a public purpose is so far exclusive as to come within this 'rule and to be entitled to protection by injune tion. In such case the commissioners appointed by law to carry out the purposes of the lottery are proper parties to institute an action in their own name to restrain a violation of the franchise committed to them; but the state is not a necessary party.l. Excerpt from A Treatise on the Law of Injunctions, Vol. 1 of 2 While there has been, of recent years, a wide development Of the preventive jurisdiction of equity in all its branches, this development has been especially noticeable in connection with injunctions against the infringement of trade marks, including what has come to be known as unfair competition, injunctions pertaining to streets and highways, and to negative covenants and contracts in restraint of trade, and, finally, the use of the writ which has resulted from the labor troubles and disturb anecs of the last decade. The growth of the law in the three branches enumerated would alone be sufficient to justify a new edition Of this work. Excerpt from Treatise on the Law of Injunctions: As Administered in the Courts of the United States and England The jurisdiction of courts of equity by the writ of injune tion, though of English origin, is largely the result of Amer ican growth and development. Perhaps no branch of equity jurisprudence owes more to the decisions of American courts, and the growing frequency of the use of this writ, of late yars, has invested the subject with a new importance. Of the more recent text-books upon the Law of Injunctions, that of Mr. Hilliard, professing to be purely American, contains, of course, but few citations of English cases, while the English treatises of Mr. Kerr and Mr. Joyce, though complete and exhaustive so far as regards the English authorities, contain but few references to the Opinions of our courts, and leave the rich field of American decisions almost untouched. And the fact that very many of the English authorities, noticeably those of recent date, are modified by statutes which are inap plicable here, has seemed to the author to create an additional necwsity for a work which should be based upon the decia ions of both countries, and which should present the general principles governing courts of equity, both in England and America, in the administration of preventive relief. Excerpt from A Compendium of the Law and Practice of Injunctions, and of Interlocutory Orders in the Nature of Injunctions, Vol. 2 of 2 Where the timber is included in a lease, the lessee may have trespass against the lessor for felling the trees, and the lessor's waste against the lessee. And if a stranger fell them, each may have his own appropriate action. When the trees are expressly excepted, the lessor has an implied power of going on the land to fall them, and may sue the lessee for any injury done to them. Where the timber is neither expressly included nor excluded, it would seem that the tenant has the right to have it continued, but no right to cut it down, unless waste is expressly authorized. 1 1 Rep. 48, a; Pomfret v.
