Over the years, policymakers have struggled to offer adequate mental health services and treatment to those who suffer from a mental illness. Those who are diagnosed with a mental illness, tend to be legally involved with the criminal justice system. In order to offer services and treatment to those in need, California voters passed the Mental Health Services Act (MHSA) in 2004. The goals of the act were to reduce the legal involvement of individuals using MHSA services and programs. This study is a policy analysis examining whether California's MHSA is decreasing arrest and incarceration rates for individuals utilizing its services. Secondary data were accessed through various government and county websites. Nine California counties were selected using purposive sampling. Data were analyzed to determine whether or not the county decreased the legal involvement for those who were utilizing its programs and services offered by the county. For the purpose of this study, legal involvement is defined as arrests and incarcerations. The data indicate that California's MHSA is decreasing arrest and incarceration rates for individuals who are enrolled in MHSA programs and services. A majority of the counties sampled demonstrated a decrease in legal involvement for its participants. The findings also show which counties succeed and which counties need more assistance in the legal involvement aspect of the MHSA. The data clearly show that each county implements their MHSA programs differently from one another, each having their own strength and weaknesses. Overall, California's MHSA is decreasing the legal involvement for individuals utilizing its services.

Abstract: This study is a policy analysis of California's Mental Health Services Act of 2005. The Mental Health Services Act (MHSA) was designed to implement comprehensive policy initiatives, to address the need for an integrated public mental health service system within the state of California. Community mental health services have been found to be fragmented and under funded, leaving many individuals and families without access to needed care. This thesis includes a detailed historical review of mental health services on a national, and state level. This policy analysis, using Gil's (1992) social policy analysis framework, explores the evolution of the MHSA and its impact on the mental health treatment provided for citizens in the state of California. The prevalence of mental health issues within this society warrants current and comprehensive analysis of the policies that govern provision of services. Findings indicate that the MHSA serves to establish long-term funding, and ultimately transformation of the public mental health system in California. Social work implications will be discussed.

Abstract: The purpose of this study was to analyze Proposition 63 which later became the Mental Health Services Act (MHSA) of California. This legislation imposes a 1% increase in taxes for California residents with adjusted gross annual incomes over $1 million. The MHSA provides funding to expand mental health programs and services, including prevention, early intervention, and education and training programs. The analysis intended to explore the benefits and consequences of the tax increase, and how mental health services are impacted under the MHSA. This study scrutinized a historical review of mental health services in the United States, information of political trends on national and state level, mental health reform, and enactment of policies related to mental health. The analysis concluded that the MHSA legislation has potentially increased mental health service programs for people with mental illness and their families. However, the study also found that the state has failed to provide proper guidance to counties for effective program evaluation.

The implementation of the California Mental Health Services Act (MHSA) represents a significant legislative wave of change for mental health services to children, adults, and seniors who are suffering with severe chronic mental health conditions. It aims to expand the state's mental health system by taxing millionaires and providing MHSA funds to create innovative preventative and Full-Service Programs (FSPs). This initiative provides better service delivery options to the underserved and chronically ill population to assist with long-term care. Furthermore, the MHSA expands access to services by designing new behavioral health programs and integrating new approaches for mentally ill individuals to ensure their needs are met. This paper intends to conduct a policy analysis of the Mental Health Service Act, Proposition 63, to analyze how affectively it has addressed the issues of inadequate mental health services. In doing so, the researchers will explore the social problem that led to the policy and contribute to existing knowledge by further examining the context, planning, programming, and evaluation of the policy. In addition, the researchers will analyze the progress of the amended policy in 2018.
