Abstract: The purpose of this study was to analyze Proposition 63 which later became the Mental Health Services Act (MHSA) of California. This legislation imposes a 1% increase in taxes for California residents with adjusted gross annual incomes over $1 million. The MHSA provides funding to expand mental health programs and services, including prevention, early intervention, and education and training programs. The analysis intended to explore the benefits and consequences of the tax increase, and how mental health services are impacted under the MHSA. This study scrutinized a historical review of mental health services in the United States, information of political trends on national and state level, mental health reform, and enactment of policies related to mental health. The analysis concluded that the MHSA legislation has potentially increased mental health service programs for people with mental illness and their families. However, the study also found that the state has failed to provide proper guidance to counties for effective program evaluation.

Over the years, policymakers have struggled to offer adequate mental health services and treatment to those who suffer from a mental illness. Those who are diagnosed with a mental illness, tend to be legally involved with the criminal justice system. In order to offer services and treatment to those in need, California voters passed the Mental Health Services Act (MHSA) in 2004. The goals of the act were to reduce the legal involvement of individuals using MHSA services and programs. This study is a policy analysis examining whether California's MHSA is decreasing arrest and incarceration rates for individuals utilizing its services. Secondary data were accessed through various government and county websites. Nine California counties were selected using purposive sampling. Data were analyzed to determine whether or not the county decreased the legal involvement for those who were utilizing its programs and services offered by the county. For the purpose of this study, legal involvement is defined as arrests and incarcerations. The data indicate that California's MHSA is decreasing arrest and incarceration rates for individuals who are enrolled in MHSA programs and services. A majority of the counties sampled demonstrated a decrease in legal involvement for its participants. The findings also show which counties succeed and which counties need more assistance in the legal involvement aspect of the MHSA. The data clearly show that each county implements their MHSA programs differently from one another, each having their own strength and weaknesses. Overall, California's MHSA is decreasing the legal involvement for individuals utilizing its services.

In 2004, California voters passed the Mental Health Services Act, which was intended to transform California's community mental health system from a crisis-driven system to one that included a focus on prevention and wellness. The vision was that prevention and early intervention (PEI) services comprised the first step in a continuum of services designed to identify early symptoms and prevent mental illness from becoming severe and disabling. Twenty percent of the act's funding was dedicated to PEI services. The act identified seven negative outcomes that PEI programs were intended to reduce: suicide, mental health-related incarcerations, school failure, unemployment, prolonged suffering, homelessness, and removal of children from the home. The Mental Health Services Oversight and Accountability Commission (MHSOAC) coordinated with the California Mental Health Services Authority (CalMHSA), an independent administrative and fiscal intergovernmental agency, to seek development of a statewide framework for evaluating and monitoring the short- and long-term impact of PEI funding on the population. CalMHSA selected the RAND Corporation to develop a framework for the statewide evaluation. This report describes the approach, the data sources, and the frameworks developed: an overall approach framework and outcome-specific frameworks.

Abstract: The purpose of this study was to analyze Proposition 63, which later became the Mental Health Serviced Act (MHSA) of 2004. This legislation imposed a 1% increase in taxes for California residents with adjusted gross annual income over $1 million. MHSA provided funding to expand the mental health programs and services including prevention, early intervention, education and training programs. The analysis intended to explore the benefits and consequences of the tax increase, and how mental health services were impacted under MHSA. This study scrutinized a historical review of mental health services in the United States, in the first years of the 20th Century, Deinstitutionalization, and enactment of policies related to mental health. Using David Gil's 1992 modified policy analysis framework, the analysis concluded that the MHSA legislation has potentially increased mental health services for individuals with mental illness and their families. However, this study also found that the lawmakers failed to provide proper guidance for effective program evaluation.
